1. Scope
1.1 This Cancellation Policy applies to all yacht excursions and charters booked with Waypoint Yachts Ltd., trading as PRIVÉ Luxury Yachts (“PRIVÉ”, “we”, “us”, “our”).
1.2 In this Policy, a standard group size booking means a booking of up to 8 guests on our luxury sports yachts or power catamarans, and up to 10 guests on our larger luxury motor yachts. A booking that exceeds those numbers is a large group booking and is dealt with in clause 4.
2. Deposits and payment
2.1 For standard group size bookings made 30 days or more before the excursion date, we require a deposit of 20% of the excursion value at the time of booking.
2.2 For standard group size bookings made within 30 days of the excursion date, we require full payment of the excursion value at the time of booking.
3. Standard bookings — cancellation
3.1 You will receive a full refund if you notify us more than 5 business days in advance of your scheduled yacht excursion. Weekends and Turks and Caicos Islands public holidays do not count as business days.
3.2 If you cancel within 5 business days of the excursion, the logistics for your excursion are already underway and we will be required to charge the full excursion value.
4. Large group and corporate bookings — cancellation
4.1 For large parties and corporate groups exceeding the standard daily guest capacity set out in clause 1.2, we require a minimum of 30 days’ notice of cancellation in advance of the excursion date, in which case you will receive a full refund.
4.2 If you cancel within 30 days of the excursion, we will be required to charge the full excursion value.
4.3 For bespoke large group excursions and executive groups requiring more complicated logistics or outside services, we may need to adjust this Policy to some degree at the time of booking. Where we do, we will communicate those changes to you clearly before any payment is requested.
5. Weather cancellations
5.1 If poor sea or weather conditions make it unsafe to proceed, we will aim to reschedule your excursion at a mutually convenient time.
5.2 Where rescheduling is not possible, you will receive a full refund.
5.3 The decision as to whether conditions permit an excursion to proceed rests solely with the yacht’s Captain or with PRIVÉ company management, and is final.
6. Relationship to other terms
6.1 This Policy should be read together with our Terms of Use. Where a signed charter agreement or written booking confirmation contains cancellation terms that differ from this Policy, those terms prevail in respect of that booking.
